Changes in mandate agreements 2017

Since the 1st of January, 2017 was introduced a minimum hourly wage for people working under a mandate agreement and a contract for the services. New regulations increase the responsibilities for employers in the case of worked time evidence. For not following new rules is a risk of a fine.
From the beginning of 2017 was introduced a minimum hourly wage in the amount of 13 PLN for all mandatories and other people on contracts for services. The remuneration in the contracts has to be specified in amount, that a minimum wage for worked hour can not be lower than the minimum wage specified by new regulations. Those regulations apply to both contracts signed from 1st January and those ongoing on this date.
If the amount for hour is lower, employer is obliged to pay the alignment. The changes in regulations specify also the annual valorization of the hourly rate. For employers who will not comply to those changes, is defined a fine in the amount from 1.000 till 30.000 PLN.
The regulations included also changes about the evidence of worked time by setting in the contracts the way of confirming worked hours on mandate agreements and archivization of documentation for three years from the date when the remuneration was obliged.
Above regulations do not apply to agency agreements etc.
