How to employ a citizen of Ukraine?

In these difficult times beyond our eastern border, we wonder how we can help our neighbors. In addition to financial, material and humanitarian aid, an important aspect that will have to be solved in the near future is the organization of jobs for refugees from Ukraine.
How to submit a job offer for the Ukrainian?
If you are an employer and would like to hire a person from Ukraine, we present the most important steps below:
- Submit a job offer at the nearest Poviat Labour Office (find its address here: https://psz.praca.gov.pl/dla-pracodawcow-i-przedsiebiorcow/zatrudnianie-cudzoziemcow/) or via the online form on the website.
- Don’t forget to add a comment to the offer: “Attention! The offer is aimed at citizens of Ukraine”.
- To upload an offer, you will need the following information:
- company name, address, telephone number, tax identification number,
- professional title, number of vacancies in the position, taking into account the number of vacancies for disabled people,
- general scope of duties,
- workplace,
- the type of employment contract being the basis for the work,
- the amount of the proposed gross remuneration,
- date of commencement of work, information on the system and schedule of working time, remuneration system, working hours and hours of employment in the case of work under a contract for the performance of work or the duration of the contract in the case of a civil contract,
- what are expectations of jobseekers, including: level of education, skills, qualifications, work experience, knowledge of foreign languages, including their level of knowledge.
To increase the availability of job offers for Ukrainians, ask the Labour Office to translate the job offer into Ukrainian. Your job offer will be entered into the ICT system of employment offices and disseminated in the Central Database of Job Offers in Poland (also in Ukrainian).
Employer, remember!
At the moment, in order to legally employ a citizen of Ukraine, you must obtain a work permit for him/her or a declaration on entrusting work.
- You can obtain a declaration on entrusting work at the Poviat Labor Office within 7 days for a period of up to 24 months (the change to extend the period was introduced on January 29, 2022).
- A work permit may be obtained from the Voivode within 30 days for a period of up to 3 years.
- The regulations that have come into force are much more favorable for foreigners and also facilitate formalities for employers who can register declarations for 24 months. What’s more, they do not have to wait until they register, because the new regulations have abolished the accounting period.
- It is also worth to mention that the foreigner’s remuneration cannot be lower than the remuneration of employees performing work of a comparable type or in a similar position.
- The employer is obliged to inform the Poviat Labour Office within 7 days that a foreigner has started work.• Changing the name of the position or changing the type of contract on the basis of which the foreigner was employed does not require applying for a new statement.
How to employee a refugee from Ukraine?
Procedures for the employment of refugees from Ukraine have been facilitated. An act which regulates a legal stay and legal work in Poland is coming into force. The mentioned special act will be valid retroactively, i.e. from February 24, 2022.
